TERMS & CONDITIONS

These Terms & Conditions apply to all services offered by Moana Surf School, including surf lessons, equipment rental, kids surf camp, corporate team building, stag & hen packages, and additional activities. By making a booking, you agree to these terms.

1. Booking
Bookings can be made via email (info@moanasurfschool.com), phone (+351 964 449 436), WhatsApp, or through our website contact form. A booking is confirmed once you receive written confirmation from Moana Surf School.
Bookings are subject to availability, weather conditions, and ocean conditions.

2. Prices & Payments
All prices listed on our website are in Euros (€) and include VAT where applicable.

Current pricing of 2026 (as displayed on moanasurfschool.com/prices):
• Group lessons: from €40 (single) / €22.50 per lesson (pack of 20)
• Private 1-on-1: from €80 (single) / €55 per lesson (pack of 10)
• Private duo: from €120 (single) / €85 per lesson (pack of 10)
• Equipment rental: €20 (1h) to €50 (full day)
• Stag & hen packages: custom pricing on request

Deposits necessary of 30% upfront for groups from 8 persons or more, rest of payment due on the day of the lesson.

3. Cancellation & Refund Policy
Proposed cancellation terms:
• More than 48 hours before the lesson: full refund or free rescheduling
• 24–48 hours before the lesson: 50% refund or rescheduling subject to availability
• Less than 24 hours / no-show: no refund
• Lesson packs: unused lessons within a pack are valid for 6 months from date of purchase

Weather & ocean conditions:
If Moana Surf School cancels a session due to unsafe weather or ocean conditions, you will receive a full refund or free rescheduling at no additional cost. The decision to cancel for safety reasons is made solely by our instructors and is final.

4. Participation Requirements
• Participants must be able to swim
• Participants must be in reasonable physical health
• Participants must disclose any medical conditions that may affect their safety in the water
• Minimum age for group lessons: 6 years
• Children under 10 must be accompanied by a parent or legal guardian, unless participating in the Kids Surf Camp programme
• Participants must follow all safety instructions given by the instructor at all times

5. Equipment
All surf lessons include a surfboard and wetsuit. Equipment must be returned in the same condition. Participants may be held liable for damage caused by negligence or misuse.

• Hardboard rental is available on request (subject to availability and experience level)

6. Third-Party Activities
Moana Surf School offers additional activities such as boat tours, quad biking, horse riding, yoga, kitesurfing, fishing, mountain biking and more. Some of these activities are provided by third-party partners. Feel free to contact us which ones are third party activities and which ones we can provide.
Where a third-party provider delivers the activity, their own terms and conditions and insurance apply. Moana Surf School acts as an intermediary and is not liable for third-party services.

7. Photos, Videos & Media Consent
Moana Surf School regularly photographs and films lessons, camps and activities for use on our website, social media channels (Instagram, Facebook, YouTube), and promotional materials.

By participating in a Moana Surf School activity, you acknowledge that photography and filming may take place. If you do not wish to appear in any media, you must notify us in writing (email to info@moanasurfschool.com) before your session or at least inform your instructor before the session begins. We will make reasonable efforts to accommodate your request, though complete exclusion may not always be possible in group settings.

Consent for use:
• Photos and videos may be used for promotional, editorial and commercial purposes on Moana Surf School’s own channels
• Content will not be sold to third parties without your explicit consent
• You may request removal of specific content featuring you at any time by emailing info@moanasurfschool.com

Children (under 18):
Photos and videos of minors will only be published with explicit written consent from their parent or legal guardian. A consent form will be provided at the start of kids’ surf camp or lessons. Parents/guardians may withdraw consent at any time.

8. Health & Safety Disclosure
Participants must disclose any medical conditions, injuries, disabilities, or medications that may affect their safety in the water before participating in any activity. This includes but is not limited to: epilepsy, heart conditions, asthma, recent surgeries, pregnancy, and any condition affecting swimming ability.
This information is collected solely for your safety and will be handled as special category data under Article 9 GDPR. It will not be shared with third parties (except emergency services if required) and will be deleted within 30 days after your activity, unless retention is required for insurance or legal purposes.
Moana Surf School reserves the right to refuse participation if an undisclosed medical condition poses a safety risk to the participant or others.

9. Liability
Participation in surf lessons, water sports and outdoor activities involves inherent risks. Moana Surf School takes every reasonable precaution to ensure your safety, including certified instructors, quality equipment and safety briefings.

Moana Surf School is not liable for:
• Loss or damage to personal belongings
• Injuries resulting from the participant’s failure to follow safety instructions
• Injuries or damages caused by third-party activity providers

This limitation of liability does not apply to damages caused by wilful misconduct or gross negligence on the part of Moana Surf School or its employees, nor does it limit liability for personal injury or death where required by Portuguese law.
Moana Surf School holds civil liability and sports accident insurance as required by Portuguese law.

10. Applicable Law & Jurisdiction
These Terms & Conditions are governed by the laws of Portugal. Any disputes shall be subject to the jurisdiction of the courts of Cascais, Portugal.
For consumers resident in the EU, mandatory consumer protection laws of your country of residence may also apply.

11. Right of Withdrawal (Online Bookings)
Under EU consumer law (Directive 2011/83/EU), consumers who book online have a 14-day right of withdrawal. However, this right does not apply to leisure services with a specific date or period of performance (Article 16(l)). As surf lessons are scheduled for specific dates, the right of withdrawal does not apply once the service date has been confirmed.
